The moot argument in in the Bobby v. Bies case (briefing here) will take place in the faculty lounge starting at 3pm, and I hope everyone eager to take advantage of this opportunity will come by at whatever time possible.
I also hope that anyone who attends any part of the moot will consider discussing the experience or on the case more generally in the comments to this post.

Just to clarify, is the faculty lounge that big room with the table just around the corner from your office on the Third Floor, Prof. B.?

This post is not at all a response to the briefs or moot, but a post that I’ve meant to do a while ago.
-An anecdote about perverse deterrence results:
I’m in the Army reserves, and I’m in charge of a platoon of about 40 soldiers. They all went to war together for a year, so they are all very close. But now back in the states, they only see each other once a month. When they do, some of them party pretty hard.
On one such occasion, the question came up: “Who will drive us all home?” To answer the question, 2 polls were taken: (1) Who has had the most to drink, and (2) who has previously been convicted of OVI? Someone drove everyone home, and because of the answers to poll #2, it wasn’t the person who had the best answer to poll #1.
I of course pointed out, in a manner not suitable for this blog, that there could have been a poll #3, Who Has a Little Money for a Cab?, but given that this poll was not taken, I thought the result was funny. I don’t believe any of the soldiers knew exactly what the consequences of a second OVI conviction are, but they had some idea. In this group dynamic, this caused the group to decide that it would be better to let one member get a first OVI (and, for that matter, endanger the rest of the group and the public to some degree), than to let any member of the group get a 2nd OVI. Enhanced 2nd offense penalties failed to serve the purpose of deterring this crime, this time.

Sounds like a rational way to decide who should drive while OVI (operating vehicle while impaired i presume??) There’s a fractional chance of being caught, but if caught, the consequences for multiple OVI is severe!
